Ministry of Finance launches second phase of Society Act review consultation
21 December 2011—The Ministry of Finance has issued a discussion paper with specific proposals for reform of British Columbia’s framework legislation for not-for-profit corporations, the Society Act. The discussion paper sets out a wide range of proposals (which the ministry cautions have not been adopted as official government policy) on incorporation and capacity, resolutions and records, members and meetings, directors and officers, restoration and reorganization, and remedies. The paper also contains a set of proposals on what it classifies as “regulatory provisions.”
The ministry has asked for comments on its proposals. The consultation period runs until 30 April 2012. The ministry is aiming at 2013 at the earliest for the introduction of legislation to reform the Society Act.
