Obsolete Remedies Against Estate Property: Estate Administration Act, Part 9 (1987)
Keywords: Estate Administration Act; creditor; will; intestacy; succession; estate; beneficiary; specialty; simple; debt; contract; execution; deceased; land; heir; deceased; property; administration; land; execution
At the time of this project, Part 9 of the Estate Administration Act contained a series of rules relating to the administration of estates. These rules were largely derived from a nineteenth-century English statute and generally concerned themselves with the rights of creditors against the recipients of the deceased’s land. This project examines whether these remedies retain any relevance in contemporary British Columbia or whether they should simply be repealed.
