Co-Ownership of Land (1988)

Keywords: co-ownership; joint tenancy; tenancy in common; severance; sale; partition; right of survivorship; title; accounting; homestead; time; matrimonial home; possession; interest; joint tenant; property; land; registration

Land may be owned by more than one person in either a joint tenancy or a tenancy in common. Joint tenancy is a more desirable form of ownership for many people, due to the fact that when one joint owner dies full title automatically passes to the other or others. Updates to the law in this area are long overdue, as the legal requirements for joint ownership are quite complex and strict, potentially making the nature of the co-ownership very different then what the parties intend.
